i had to trim a large cherry tree. cut it back about 4-5 ft, away from the house, and all the way up. i aint into being that high up in the air, so i called a guy that one of my clients reccomended. i brought him to the property, he gave me a price. i said ok. he said he'd get to it today, cus his crew was working close by. i said, "great, thanks alot, here is my adress, when you're done, just send a bill, i'll get a check out to you within 30 days." guess what he said

You guys are too funny but this is one where bg is going to huhuhu maybe fool us all with some total off-the-wall answer because one thing's for sure bg, I myself would've told you to kiss it even if I knew who you are.
I bet he said: You ain't my boss, ole boy.
Or did he say: Gee BG thank you for allowing me the awesome opportunity of being your slave, I look forward to working for the great master and hope for only a tiny share of your profit, really I'll gladly work for free just to make sure you can collect your percentage of the referral because I am certain the education will be well worth it.
ok lets hear it lol

well, let me ask you, SHOULD he have billed me? if no, why not? you guys always say, you send a bill. no need to demand payment up front, or, expect the client to take the day off from work, to be there. well, in this case, i am the client.

No, your customer is the client.
It's their yard, their tree.
If you could've done the work (assume), you would've billed them.
So whoever does the work bills them.
Now if you don't want to refer them to someone else because you feel it is your customer and you're not in the mood to share for free, that is your choice. But once you refer them to whoever, that person collects the check direct from your customer, your job is done, you're not dealing with the tree, they are.

sorry to get on you there earlier, but it was just too hard not to

He probably told you he could not do it without the homeowners consent. And needed to talk to them 1st.

But it's neither your tree, nor your house.... Ok, well...
I had this problem with a guy last year, would call me to get me to do some work until I found out about the whole deal and it was just like your deal: I do the work, client pays him and he pays me...
At the time I didn't think much of it because I got paid what I would've gotten anyway but what happened the next time he wants to go pick up the supplies, do you see where this is leading? Now I would really have no problem with this except the guy didn't have a clue as to what he should get, so he calls me from the STORE (arrrrgggh my landscape supplier) to ask me stupid questions and by the time I got done walking him through, I could've done picked the stuff up myself, but now he also pockets the delivery fee, MY delivery fee. What's next, how about I just show up to do all the hard work while he pockets every dollar for all the run-around easy bs stuff like estimating, supplies, collect the check? Well shoot if it was that easy, everybody'd be doing it but I don't think so! You want the easy money then you can do the hard part, too.
He's just a middleman, to me this type of business owner has no room to meddle in my affairs because when it comes to my business, I deal only with the horse directly, I don't need the jockey or the trainer to handle things for me, if I wanted that then I would've hired employees by now. And that's likely the way the tree guy feels, or felt.
Even if it isn't, it's too much rigmarole, too much a chance something gets lost in the shuffle... Because my price is my price to the customer, there is no room for extra 'referral' fees someone else can just step in the middle of things and start collecting because someone has to pay this little fee and if the customer has to pay it then it's gouging and if I have to pay it then I'm losing money.
As far as advertising fees, if you want to refer customers to me and collect the advertising fee as it does cost money to attract customers via advertising, then as soon as you start generating 3-4 calls / day until I have had enough, I'll be glad to pay you 85 dollars a week or so for the service but the calls have to convert at least as well as my current advertising scheme's.

Topsites you are so wrong. First, tree guy doesn't have job without Bobby. Second tree guy is a sub of Bobbies, if not then he would just be a referral.
Topsites are you a female? (can't tell by name) Because I have trouble figuring them out to.

I agree but did Booby make a sub-contractual agreement with this guy. Normally this would get Bobby a slightly lower price for a promise of all future tree work. They would then have payment terms agreed on. I have a feeling this guy treated Bobby as a normal customer though.
He probably said he needed the money at the time of completion. My tree guy invoices me, but I don't live in Jersey either. All my subs invoice me and they get 1099's at the end of the year unless they are Incorporated.

ok, well, normally i would pay any sub on the spot. that's just the way i feel business should be done, he don't know me, and i may not have any other tree work for a few months, if, at all. but i was thinking about what you nice people say, that, u know, maybe i'm just a bit uptight when it comes to payments. so i decided to see how your way would pan out, u know, business on a handshake, and ask him to bill me. so, it went down like this: he said he wanted $350, and he could get his crew there before dark to trim the tree. i told him i would not be around, so, i wrote down my name and adress, and told him to just drop a bill in the mail. i thanked him, and turned to walk away.......i felt a hand on the back of my shirt, then a voice " amigo, u wanna the tree a trimmed?" i said, "yes, i do." he replied with, "give a me a my a money, or i slit your gringo throat." i guess that meant he didn't like the payment arrangement. so, i left a check.

No I'm a guy, look... I'm not going to argue with you guys over this, some folks see it your way, others see it my way: When you run into me, we can't work together because we don't see eye to eye, but it doesn't really mean either way is wrong it's just different way we see things.
