If you lien a property and it goes into foreclosure will that lien entiltle you to monies due if the property sells?

I might have lost out on $1300.

Only if you are at the top of the heap. We've liened a property and weren't payed a dime when it went into foreclosure.

Only if you're lucky. You'll get paid according to your place in line. In other words the 1st mortgage gets paid, then whomever is next and on down the line until the money runs out. Chances are the money will run out before the 1st collects all their money.

depends on where you live.

Here, mechanics liens come off the top. Once the property has been "attached" it cannot be sold until the lien is satisfied. I've collected liens on several foreclosed properties just this year.

However, any other type of lien and you're SOL

Is it a resi or commercial? If it is a commercial go to small claims court. It's a pain but you will eventually get paid.

It's a resi. This guy went into foreclosure the winter of 07-08. He was a great customer for 2 years then last summer I started getting suspicious when he started paying me with money orders and cash. Then he just quit paying me all together.

I thought about putting a lien on his house but from what I was told by a company that handles liens said that it would cost me $250 to file one and that a lien on a property for lawn maintenance services would be an invalid lien. I hear from others on here that you can file a lien and get paid. So which is it? I'm sure it varies from state to state so I guess I'll have to check more into it.

Now the strange part...I get a call the other day from a guy who says he's seen me around his neighborhood mowing. He asks me if I'm interested in cutting a home he just bought as an investment. Of course I say yes and ask him to give me the address so I can swing by and look at it. He says, "You already know where the house is......It's (guy who owes me $) old house, I bought it and fixed it up, I live 2 doors down the block!"

Look in the yellow pages and find a law firm that deals with collections. For 1,300 they will gladly take up the case and get your money legally. If bankruptcy occurs your screwed. Expect the law firm to take 30-50%, but it's better than nothing. Society has lost all values and people who exploit or take advantage of others should be punished severely.
