While backing down a narrow dead end street, I had to move over to allow a passing car go by. By doing this i hit a basketball net with the top of the dump body. This basketball net was rite on the curb, no sidewalks, and hanging 3 feet into the street. I left a business card and note. The owner calls, flips out. Try to reason with her. I've been playing phone tag with her. My question is am i liable since this net was hanging into the street less than 8 feet high or should i pay for it? Thanks.

Sorry, Left that part out. It is bent, leaning to the right. Tried bending it back. Got it back a little.

I think so because the net was there all along, not sure exactly but it's likely
not worth the argument, the easy solution is to fix or replace it.

We have ordinance here that prohibits those things being left in the street. If i is overhanging, then it i in the street. What if it was on that street (or any other street), and a vehicle was approaching from the other direction, or was parked across from it, and another vehicle is coming down the road? As it impedes traffic, it also creates a hazard. If a kid leaves a bike laying in the road, and it gets ran over by someone backing out of a drive, it is not the fault of the driver. Call your local police dept. and find out their stand on this. Its a GOOD thing you didn't mess up the side of a nice enclosed trailer, otherwise THEY could be held civilly responsible.

It is worth the arguement, these nets aren't cheap. Street signs, lights and wires hanging over public streets have to be a certain height so things like this could be avoided. This net couldn't be seen in mirrirors, was hanging 3 feet into the street.
I have contacted the local pd and are wating a call back.

stupid people doing stupid things! ya just gotta love it. then she has to be a jerk about? geez.
Call the cops, see what your rites are and how the law reads. If its in your favor then maybe you should lert them to a potential hazard and they can go "talk" to her. Even if you end up paying for abasketball hoop she'll be paying for a ticket (hopefully).
If its a public street call your public works or street department. Around here that is a big no no cause it could hit a snowplow, fire truck, etc. and the city owns so many feet in along the road or street.

F THAT! If a city truck, or a school bus ran into it, they would be ripping her a new one for having it in the street. She should consider herself lucky that isn't what happened. She doesn't OWN the entire street.

Did you take any pics? Granted, by the fact that you damaged it means it was in the street, however, pictures never hurt.

There was no damage to my truck. The net got caught somewhere on the cab protector on the passenger side. Still waiting for a call back from the pd.

you should have taken the whole basketball hoop and she might have forgotten she even had one.

Woo Hoo! Justice. I agree, I don't see how what they had set up what that goal being legal. That could have damaged a fire truck or an ambulance, etc, if they had been in the same situation.
I assume it was a pole set in concrete or packed dirt? I've seen people use those protable goals with the big plastic, water filled, counterweights on them over the street, of course a non-busy street, but that's not a permanent post either.

Something I've learned is never get in a pissing match with a customers neighbor. If its easy to fix/replace its worth it in the long run to just tak it with a smile. Don't worry about what the laws/ordinance/Covanances are.. and always remeber there are angry people everywhere wanting to take their anger out on someone... dont let it get to you!

In this area the ROW has to be clear of obstructions with a minimum 8ft over a sidewalk and 16ft over a street.
