Hey ya'll,
This is my 4th yr in the business and I mainly work in residential and commercial mowing. Ive had many customer requests for fertilizing programs over the past 3 years but I am not licensed and don't really have the time to get into it and learn it all. So, a friend of mine has been doing it for quite some time and I have decided to offer him to my customers, I've even gone as far as putting his contact info on my flyer so they can contact him directly about fert programs. So my question is, if he messes up somewhere on someones lawn, am I liable for this? Thanks for any help you can give!

Id say no, Hes not working for you he is doing it on his own so he has no involement with your business. He is a refered business and did it on his own.

I would make sure he is good though, otherwise they might look the wrong way at you.

I might be doing the same thing this year

Not if he's a referral and not a sub...that doesn't mean your customer's won't hold it against you though. I've gotten really really careful regarding who I recommend now.

When I make referrals, I tell my customer that I have recommended this person to many people over many years and he has done a great job and I have heard no complaints. However, since I am not the person doing the work and I cannot control what he does; if for any reason you are not satisfied I want you to let me know so I can talk to the contractor to help fix the problem or possibly stop referring that contrator.

Are you liable for any damages? If there is a lawsuit any scumbag lawyer can add you do it since you were "involved". The lawyer may just be looking for you to throw them some money to make them go away.
