What is the penalty for not suppling employees their W-2's by January 31. I don't have employees but my last job went into Jan. and wanted to know the penalties envolved with this.

A couple of years ago my W2's went out late (a week) and I was not penalized.

There is supposed to be a fine (or an audit) if you get reported...just wanted to know what it is. In your case you probably were not reported.

I think if you look in the instructions for the W-2's it states that they are "generally" supposed to be mailed by Jan 31.

I have checked their website and all it says is that a complaint can be filled out. Really doesn't say anything about penalties. They may not give them out.
