You must be aware of the Fair Labor Standards Act which is a federal policy that protects employers from over working employees without OT.You can classify employees as salary but it cannot be a decrease in pay it must be an increase for example if an employee was making $10/hr x40hr per week =$400 the employee cannot make less then that. In NC that must be a supervise of at least two other employees and paid a minimum of $455.
