super z with 37 kawi won't start

I have a 2011 super z with 80 something hours on it and when its cold it will not start. It has been at the dealer now for over 5 weeks and they can't figure it out. This is most frustrating, I just found this site and I hope someone can help. The engine does turn over, I bought a new battery, the starter was swapped, the valves were adjusted, but when you try and start it it seems sluggish and lets out the loudest backfires. Once you get it going (after swapping batteries and then using a booster pack) it runs fine but you can't let the engine get cold. I am at the point where I want nothing to do with this engine and I want it swapped. Any insights,

Alls well that end well.
As soon as i started emailing Hustler they got the situation fixed in one day I am impressed with that, good customer service.

As far as I know they don't know yet, the temperature here is warm enough that the machine will start. They are sending me a new one with a bigger battery and wires. I wanted nothing to do with the old engine, the amount of thunderous backfires made me nervous of any damage being done to any seals valves etc and if it started happening again in the fall I would blow a gasket.
