Keep in mind the FDCA exists for the following reasons:
- To protect against unfair tactics being used to collect a debt fairly owed.
- To protect against any tactics used to collect a debt that is not owed.
- Not intended to be used by debtors to get out of a debt that is rightfully owed.
I know a lot about this topic. I never heard of a Fair Debt Collection Act. Is that a state law???
There is the Fair Debt Collection Practices Act (FDCPA) which is a federal law, but it only applies to third party debt collectors and not original creditors.
Anyway, publicly humiliating a deadbeat is asking for trouble. If you mess around with the wrong type of debtor, you might get sued. There are better ways.
