Does anyone have any info on average cost of soil remediation? Excerpt taken from Purdue 2012 Imprelis update... "For 2012, Purdue specialists do not recommend
planting new trees in the same area where a damaged tree was removed — unless the entire tree is removed (shoots, roots, bark, leaves, etc.) and several cubic feet of soil surrounding the tree are also removed. Soil removal will be necessary to protect newly planted trees from being exposed to the herbicide. Although replanting a tree in an Imprelis®- treated area could be risky in 2012..." |

Chicago Tribune "Problem Solver: DuPont herbicide Imprelis kills tree, but restitution moves slowly." read today's article...if this guy only knew half the story! Had a "Dupont" visit last night from Davey Tree and a third party rep from "Dupont" to verify my claim. What a joke! As usual, I asked about the timeframe. Would I hear from Dupont in 6 weeks, 6 months or 6 years? They didn't know but my claim pkg. was close to being completed. Forgot to tell them it couldn't be 6 years as the Michigan Statue of Limitations for product liability, injury to personal property and negligence is only three years from the date of injury. OMG Dupont is on my last, thin nerve.

I am quite happy that I found this forum. Thank you to all for posting such great information.
I am President of a homeowners association that has extensive damage from Imprelis. As of the inspection done in December 2011 for a claim filing to DuPont, we had over 200 tress showing various degrees of damage from Imprelis. Of that total, 35 were rated either 4 or 5. We have had the same frustration as everyone else in trying to get information from DuPont. However, 2 weeks ago, we were called by DuPont and told we should have their Settlement Agreement in 3 weeks. Naturally, we are quite anxious to see what it is. We are located in Warrington, Bucks Co., PA. If anyone can recommend an attorney in our area that is familiar with Imprelis claims, I would appreciate it. I would not be at all surprised if that is the route that we will wind up taking. Again, thanks for all the info and I will let you know how we make out. |

I think you are facing what most of us will face if we sell. I agree, talk to an attorney NOW, don't wait. If it wasn't disclosed till after the sale, you might have a case. The homeowner wasn't honest and should have disclosed the information to the realtor and to you.
Doesn't sound like the LCO is being up front or maybe not giving you up to date information. My trees are starting to get bugs, nature's way to clean up the death. Quote:

One of my dead 35 foot trees is on the corner of my house (I know, bad, but i didn't plant it). To remove the stump and soil required for replanting, i would need to redo my incoming water service, irrigation system and NG piping most likely. When i asked the Dupont rep how they pay for that possibility, they said the 15% would take care things like that.
