Hahaha! I feel dumber every time I'm forced to say one of those stupid terms because clients think that "trimming" means that I include "trimming" their entire 200' of hedges in the price of weekly mowing.


Also, you forgot the worst of the worst... weedWHACKING!

So now that it's a little clearer what she signed when you presented the contract it seems that they could be in breach of the contract for getting rid of you. You should contact the owner (her boss, probably better if you went in and talked face to face), about why you were let go specifically. If weed control is brought up, you have arguments and I would recommend asking him/her to review the contract that was signed to see if you missed something (being nice about it and putting it on his desk is your way of putting it back on him). When they try to find a hole then you take that information and do two things with it: 1. Tell them that the contract stated "such and such" and that is what you were doing, and as a matter of fact you went above and beyond. 2. If the "hole" they find is large enough that you won't get the contract back then learn from the mistake and write down basically the hole they are using and patch it up.

If they want to make a change you can not stop them but you can make sure they do not sully your reputation.

Ok then so why do so many guys go for signed contracts. Contracts are for exactly that. I agree that in the long run reputation would be something to be discussed or concerned with but if these folks signed a year contract and they get rid of something they aren't paying him to do yet asking him to take care of it, it's a valid argument. Will he win? No, most likely not but it's a valid argument still.

The main reason I submit a proposal, is it spells out the services and the cost. There is always a 30 day out on a contract, I have a provision in mine that I can submit a final bill for services rendered. IE flat rate does not mean flat service. If I dump a load of Mulch on someone and bill over 12 month. They will pay me for that pro-rated mulch upon seperation.

It is a concept most professional companies and manager can grasp. The equal billing is for their benifit. I get cash flow in the off season, some work for my guys too.

I have no desire to compel someone to do business with me if they are no longer satisfied.
