Can someone tell me what kind of tree this is. Sorry for the poor picture, but this tree isn't do so hot.

It doesn't look dead in the pic, just dormant. The leaves under it look like they are from last fall and that it will be putting on new leaves soon. Try and break a branch, if it snaps its done, if it resist just dormant.

The guy said it never came in nice. It is a new account so I don't know what it looked like in the summer. I was going to take it out and bring it home and keep it for myself.
