Contract Design

    I went to the contracts templets that gopher had, and mereged certin parts from some of them and this is what i came up with. what do you guys think:

    Lawn Care & Maintenance Service Agreement

    This Agreement is made ______________, between, Gator Lawn Care and ______________, _________________, ______, ____, ____

    In consideration of the mutual convents herein contained, the parties hereby agree as follows:

    Services Provided: G.L.C. (Gator Lawn Care) agrees to provide the services specified below. Services are provided for the lawn at ___________, ________. _______ Only.

    Term and Termination: This Agreement shall be in effect through the _____-_______ mowing season ending ___________. Termination may be by either party upon 30 day written notice.

    Payment for Services: G.L.C. shall submit invoices by the 5th of the month for services during the previous month. No payment shall be taken during time of service. Payments are due no later then the 20th of each month. (Unless pre-paid) Any accounts 30 days past due will be charged a finance charge of $15 per month. Any bill not receiving full payment within 30 days shall be considered delinquent. All services will be temporarily stopped on any delinquent account until full payment for services rendered has been received. In the event of default the client agrees to reimburse G.L.C. all administrative costs, collection costs, attorney fees, recording fees and/ or court costs.

    Capacity: G.L.C. shall perform all services for________________ as an independent contractor. G.L.C. shall not be deemed as an employee of _______________. _____________ will make no deduction from payments due to G.L.C. for state or federal tax purpose. G.L.C. agrees to be responsible for any and all taxes and other payments due on payments received from _________________.

    Transfer: This Agreement and the rights and obligations of G.L.C. may be subcontracted, assigned, or transferred, in whole or part, without the written consent of _____________________.
    Entire Agreement: This Agreement constitutes the complete and exclusive statement of the agreement between the parties with regard to the matters set forth herein, and it supersedes all other agreements, proposals, and representations, oral or written, expressed or implied, with regard thereto.

    The parties have executed this Agreement as of the day and year set forth above.

    Services to Be Provided

    Grass Mowing once per week during the growth season (September- April) and bi-weekly or as needed during the summer (May- August). The number of cuts will be approximately 35 throughout the contract length. This service will include strimming, edging, and blowing off concreted areas.

    Other services will be priced separately outside this Agreement.
    Notes to Service Agreement

    If you are not satisfied with the level of service you are being provided please notify Gator Lawn Care immediately so that we can correct this in a timely manner. Gator Lawn Care strives to complete work in a respectable manner each and every visit.

    If a dog is kept on the property, customer must have the lawn free of pet droppings, when contractor is scheduled to service lawn, or customer will be charged a $10 equipment clean-up fee per visit.

    Gator Lawn Care is not responsible for any damage of items left on turf areas and/or malfunctioning sprinkler heads.


    10% down payment of $290 (this gets applied to the 11th, 12th month payments) then 10 monthly payments of $145.00 for a total of $1740 is to be paid to G.L.C. for the above services. Payment is due on the first month after the start of service.

    What is strimming? I never herd anyone use that word before. ;)
