Here's what's up. I live in a town of 15,000 people and a county of 35,000. Town is call Brookhaven. They are tons of businesses that uses brookhaven as a name. example Brookhaven glass and so on. I wanna use Ole Brook Lawn service. Problem is they is a guy that own Ole Brook Pest. I know lawn care is not pest control. But i just wanna be sure before i go with my choice. there is even a Ole brook tire. I dont want people to think olebrook pest is the same company as olebrook lawn service. What do i do?

    Find a different name.
If you want to be different than "Brookhaven" this or that and there's already enough "Ole Brook" this or that. What's the difference?

Here's a novel idea. What is Olebrook pest's reputation? If it' s good you could approach him with the idea of networking the two companies for mutual benefit. This is of course assuming you are not getting into the pest side.

@lyndont: Each and every company has to be registered with the county and state, check with your local counties Clerk services to see if the name you want to use is taken or not.
@Lefet: Make it a new name, don't piggy back your towns name like the rest, stand out.
I have already checked the U.S. Patent and Trademark Office. There you can check to see if the Trademark (which can be a name or icon) is taken.

Small towns like this are funny sometimes. They might prefer to cater to the hometown name.
