employee contracts

    does anyone use contracts for their employee, with statements containing items like: should you elect to go into business on your own, you will not do business within a 50 mile radius of ( your company)?
    and : no moonlighting in any field that involve lawn care and landscaping?
    if you do, is it any good? does it work? and if it is good could you send me a copy so i can get an idea on how to set up a good one.

    Using a contract for executive level employees is not uncommon however I doubt that using contracts for hourly employees will be effective.

    That sounds like a non-compete agreement. I know there's something about that in this forum somewhere. As I understand it from John Allin (and weigh in here John if I'm wrong), it'll stick if you compensate the person for the signing the agreement.

    But there's also the enforcement end of it. You have to take time of yours to catch her/him breaking the agreement, then pay your attorney to drag the person into court.

    yes that is what i want, a non compete employee.
    i am sure everyone has had employees that have worked on a lawn, say a $45.00 lawn, and he made $9.00 for cutting it, so he thinks that you made $36.00 for what he did. so he thinks "hell i will by a mower and start my own business," so he starts working on your customer, offers them a lower price then starts out on his own. then when he finds out that the $36.00 does not go into his own pocket, with the bills and overhead, he goes bankrupt, then the customer calls you and wants you to start cutting his grass for what you past worker charges.
    i want where he not only can take your customer, but he can not go into the same areas as your customers, at least for a period of five years.
    i know there is someone out there with a good agreement, one that would hold up in court if needed, so will you please share it?
