Here are the rules everyone....please read over them so you know and so your memory is refreshed if you are a veteran of the site...

LawnSite.com Rules, Regulations, & Posting Guidelines

Please Read The Following Rules & Regulations Before Registering At LawnSite.com.

By completing your registration and becoming a member at LawnSite.com, you have agreed to abide by and follow the rules created by ownership (listed below) at all times. There are no exceptions to the rules. LawnSite.com owned by Lawn Care Success has the right and option to change these rules without prior notice. All of the rules stated below refer to not only the public forums at LawnSite.com, but the Private Forums, e-mail and private messaging as well.

1. Advertising of any kind is not permitted at this site unless you are a sponsor. If you are interested in becoming a sponsor, click here. This includes mentioning manufacturers, dealers, etc… in the forums or through LawnSite.com e-mail or private messaging. You are also not permitted to include phone numbers addresses, fax numbers, e-mail addresses, or web addresses or links in your posts, e-mail, private messages or signature lines.


2. Links to and/or mentioning other Green Industry forum sites is not permitted at LawnSite.com.


3. You are not permitted to use obscene, vulgar or explicit language at the site.


4. You are not permitted to discuss, mention or make reference to illegal activities, including but not limited to drugs, terrorism, etc…


5. You are not permitted to post or mention any material or information that defames, abuses, or threatens physical or emotional harm or death to others or oneself.


6. You are not permitted to post any material or pictures that depicts violence.


7. You are not permitted to list names, phone numbers, addresses, e-mail addresses, fax numbers, post office box numbers, etc…. of any others except your own.


8. You are not permitted to pass off as one’s own, or solicit for the exchange, sale, or purchase of content that infringes anyone else’s intellectual property rights, including but not limited to any copyright, trademark, rights of publicity, rights of privacy, or other proprietary rights.


9. You are not permitted to include, mention or post links to pornographic, drug related, or violence web sites or material, including but not limited to child pornography or all other types of pornography.


10. You are not permitted to post or mention information that contains content intended to victimize, harass, degrade, or intimidate an individual or group of individuals on the basis of religion, gender, race, ethnicity, age, disability, or sexual orientation. Hate speech of any type will result in suspension at LawnSite.com.


11. You are not permitted to exploit a minor in any way.


12. You are not permitted to harass other members at LawnSite.com. This includes offensive remarks or remarks that attempt to provoke another member. Sarcastic baiting is also not permitted. If you disagree with someone, state why, but do not resort to name calling, threats, etc…


13. You are not permitted to use LawnSite.com to spam members for any reasons. This includes advertising products or services, promotion of a web site or another Green Industry Forum. LawnSite.com will exercise it’s rights under the law to pursue legal action in regard to this matter.


14. LawnSite.com reserves the rights to suspend and remove (ban) memberships at any time.


15. LawnSite.com staff has the right to edit or delete any information at any time posted by any member of this forum.


16. LawnSite.com is the sole owner of the information posted at LawnSite.com. You are not permitted to take information, posts, comments, etc… and reproduce them in any manner without prior written consent of LawnSite.com.


17. LawnSite.com will enforce the “3 strikes rule”. If you break a rule you will be warned by a moderator or staff member. If you break a rule again, you will be suspended from LawnSite.com for a minimum of one week. If you break a third rule you will be permanently banned from LawnSite.com.


18. If you are banned or suspended from LawnSite.com you are not permitted to register under a new name. Only one user name per person is permitted. All additional user names or new user names without permission from LawnSite.com will be deleted from the system.


19. If you sign up with or attempt to use a non-working e-mail address, LawnSite.com has the right to remove your membership from the site at any time.


20. You are not permitted to post or insinuate false information about members as well as sponsors. If you have never owned or used (at great length) a product offered by one of the sponsors, you are not permitted to comment on the value, validity, or effectiveness of these products or services.

OK now this would apply to all the websites some members have on their signature. This also applies to when someone asks where to buy mail order parts and goods. Any mention outside the list of sponsors. Looking for an Exmark? can't list a dealer, for that would be advertising for the dealer not Exmark.

Part of this rule is already inclusive with rule #1. And it lacks adequate explanation of "Spamming" of which is intermingled in rule #1 Basicaly this rule is repititous

Not really repetitive. #1 refers to advertising more or less on the board, or in a "subtle" way, which happens all the time....You usually don't see these types of posts because moderators are usually on top of this.... #13 is specifically referring to spamming members whether Green Industry related or not...which happens from time to time.

Members helping members is one thing and will obviously not be frowned upon....but when a member has made 45 posts and 41 of them are about "XYZ Company", it's not to hard to tell what they are up to.

Meanwhile in rule #1 it clearly states

"This includes mentioning manufacturers, dealers, etc… in the forums or through LawnSite.com e-mail or private messaging."


Further more. How can you possibly restrict a private email or message? It is private. You censor a mode of communication that is deemed "private" it is against the law regardless if you are providing the ways and means. You include the term "Private" it is then clearly that "Private"


And 4 and 6 can be included to one rule.

GLAN.... 4 and 6 are different and therefore separate....mentioning drugs and posting a depiction of violence don't really fall into the same category....

Also, you are incorrect about PRIVATE messaging, trust me....if not me, ask an attorney (I did)..... I can change it from "Private" messaging to "super duper quiet on the down low" messaging....my point is, what it is named does not have any bearing on what can or cannot be done with it.

Oh, and yes GLAN, you can post a link to Gempler's....

All e-mail and messaging is private, unless you put in your terms of use that it is subject to review by the admin or his employees (Moderators)

Or didn't you attorney tell you this MINE DID!!!
4 - 6 - 10 and 11

Can be grouped into one rule

There is no desperate need to seperate them. Each of those rules pertain to posting. But that is the first in more than 15 years have seen a site mention exploitation of minors, an ISP yes. How it pertains to LS I'm not sure. Or even why?

Oh and uh....................this is not baiting, nothing I have done in this thread can be catagorized as such.

PM's and email are sent through a database and encrypted. We have to rely on members reporting and or forwarding messages that might infringe on rules and regulations.

When I was cutting and landscaping I could only wish that I had this much extra time to critique business that was not mine.

But it does go by the word.

"Private" is just that.

Now if was worded "email through this site or direct messaging is subject to the same rules". Then you have a legal right to monitor and censor as you would the forums.

Where the rules say that the mode of communication is "Private" there is no interperatation. It does have a bearing in the courts. Thus rules do not apply.

For if someone reports it. And if action is taken to revoke ones membership based on that, then it is no longer "private" as stated in your TOS. Justified legal action can be taken against the party enforcing the revokation

Provide the ability to report messages that violate ROC, the termininology "private" does not exist and should not based on the definition of the word. There is not or any implyed interperatation of the word.

Regardless... admin or moderators can terminate a users membership at any time, and at its sole discretion, with or without cause.

So, we don't have to 'base' our actions on any reason.

Yes that is true
This is not a public site. It is a private enterprise. And that holds more weight being that membership is free.

A paid membership a course of actions needs to be taken and notice given. No different than a country club and it's bylaws.

The paid is irrelevent, worthy of mentioning though.

Hey Chuck Sinclair and GLAN sounds like a little competition from an upstart trying to take on the big boys. Looks like I have inside knowledge since I can read between the lines.

This is the best lawn site so give it up.
