Had my windshield broken by someone trimming

Monday, I was driving down a 2 lane hwy on my way to the dealership and came up on a prisioner work detail trimming along the road. As I passed, a rock hit my windshield hard enough that the person i was on the phone with heard it. I turned around, pulled up on the guard, and told him what happened. After looking at my windshield, he called someone on his phone and said "we broke another windshield on 92" and gave me a # to call and had a cop come give me a report#. He tells me it happens alot, which is understandable, and I tell him i am a lco and sure it would happen to me too if I was trimming miles of a busy 2 lane hwy, but I knew I would be buying a windshield with no problems if I did it. THATS WHY I HAVE INSURANCE! Well now city finance dept. calls and wants me to claim it on my Auto Insurance and they will pay the deductible. I dont think so. But I call my agent anyway, (who happens to be my girlfriends mom) and she agrees that I shouldnt have to claim it. Also my deductible is $500. New windshield $222 New Tint Strip $25. It just pisses me off that the city wants to find a way out of it when they are getting free labor from the prisoners, half of who probably shouldnt have a dangerous tool in their hands in the first place. If it was me that had done it I would pay for it out of pocket or claim it on MY insurance, not theirs right away. I would expect this out of one of these scrub, low balling, uninsured "companies" I see all over the place, not the city I live, and pay taxes in.

Sad that they've apparently had more than a few broken windshields
but I don't personally think I would have even stopped, just the way I am,
I accept a lot of things like these without trying to place the blame and who pays for it,
the point being if my truck throws up a rock I won't pay for what comes of it, either.

Road hazard, it happens.

How bad is the crack?
Don't tell me it's just a little ding the size of a quarter :p
You can have those repaired for like $50-$80, or even DIY thou it is kind of a pita and still costs $15-$20 for the kit.

Yeah, stuff happens, but when there is 6 prisoners all with trimmers about five feet from the road, I wouldnt call that a road hazard. I know If it was me running that trimmer, someone would probably stop, and I would pay for it. Now if it was some guy just starting out in the biz, i would probably just let it slide, but the city with prisoners out there?

I had a similar thing happen to me a few years back. I was on my way to the rifle range. A school employee was mowing a ditch with a ztr, no deflection guard, threw a rock and hit side window of my camper top. I turned around and followed him to their barn and reported it, then had to go to administrative offices.

They tried to give me the brush off, then wanted me to file and they would pay deductible. I said no way, why should my insurance have to pay for their negliance. They paid the whole bill. The administrator's assistant addmitted going to a loss seminar a couple of weeks earlier where the issue of discharge chutes/deflectors was addressed.

I hate this subject. I've paid for more than I care to because everyone thinks businesses are loaded with money, have insurance, etc.

Not just a hazard of the road, someone has to pay.

Had one this year. Employee tells me about it, I get a call from the guy and he tells me his windshield was destroyed, blah, blah, blah. Had a chip in it, one that was repairable. Of course the glass company and the guy think I should replace it, I said sorry, you can have it fixed, I'm not paying for a new one when it is repairable. Glass company said it was, but they wouldn't recommend it. But they advertise all day long about window chip repairs. :rolleyes:

I've had a chip in one of my truck windshields for 6 or 7 years, no clue how it got there and even if I did, I wouldn't care. It hasn't spread, haven't had it fixed, it's part of driving just like stone chips.

Poop happens people, move on with life.

Funny or stupid thing is, the OP doesn't think he is paying for a new windshield, but who is paying for the insurance for the prisoners? Congrats, you just bought yourself a new windshield with your tax dollars.

This same thing happened to me in Morrow Georgia which is about 15-20 minutes south of ATL.

"Public Works" had about 5 prisoners on weed eaters and 1 'foreman' on the Z. I was stuck in traffic watching the guy on the Z as he completely ran off a curb into a road. Next thing I know, BAM! A stone was thrown at my windshield. I pull over, tell the foreman what happened, and call the police.

I ended up fixing it on my own dollar since it was just the size of a penny and they 'repaired' it.

It was obvious that I was going to have to go through a ton of hoops to get them to pay for it. Time is money to me and I said **** it and paid for it myself

That's how government claims work...It's just like the Michigan no fault law. They are NOT going to pay for it, nor are they obligated to. You pay your deductible, your insurance company files with them, and you get reimbursed from your insurance co. You'll have to tell mother in law that her company is going to have to do a little bit of work for all the money they take from you. That's what they get paid for. They aren't out anything,...they just need to handle their responsibilities of customer service. Oh, they don't like to,...they are insurance companies...but this doesn't change the fact that this is what they are there for.

We have the same problem here except its not prisoners, its city workers!!! These guys have no regard for your truck or trailer, they just blow the grass and rocks right towards the flow of traffic! I call the main office every now and then to complain but it does no good when the foremen are the main ones doing it!
