I am a Professional drummer striking fame but i want to keep my solo mowing business running . I have a family member wanting to do it . I do not want to pay workmans comp again , so can i sub it to him ? Any help at all would be deeply appreciated . He will have keys to entire rig, enclosed trailor , building, tools , plenty of mowers and back-up mowers too . I would give him a gps , black berry , keep hi-tech for comunication . I can still be home a lot to iron out problems , make repairs myself , mow some . I have NO KIDS ,and my wife is letting me do it . Opportunity is Knocking very hard ! Any tips from you Experienced pros would be deeply appreciated !!!!!!

He would really need to use his own equipment to legally sub it to him. If you pay him to use your equipment he's basically an employee.

One way I would think would work but I would talk to a lawyer about it is to lease your equipment to him. He then would be in charge of the equipment, scheduling, insurance, expenses, and doing his own books, which is legal. You would need insurance for the work and make sure it also covers subcontractors.

Good Luck, many people cheat and just act as he is a sub while by law he is a employee. It's all fine and dandy until a person gets caught or a accident happens.

Just make him use his own truck and give him a 1099. Make sure that he is clear that he is a subcontractor and has to pay his own taxes. His truck is his tool for the job. Im sure some will argue but if it were me thats what I would do since he is a family member. Oh ya by the way check your laws ...it may be different then it is in texas.

Hmmm...I manage a nationally signed band that will be releasing a cd in all major stores this September. 40 shows a year isn't a lot...that's weekend warrior stuff...less than 4 shows a month. Why do you need to walk from the business if you're being flown in and out from shows? I could see if you were driving to and from.

Well, don't get me wrong now...

But seeing how it ain't the first time I thought I was going to hit the jackpot in this life,
I thought to tell you, until you see a picture of your face on the cover of RockStar
magazine, you might want to hang on to your daytime job another week or two.

I'm just saying, slow down a little because...
Anyhow, long story short lets just say I'm glad I didn't hang my own lawn mower out to pasture just yet.
One other thing...
It's Chile.
You hanging out in Santiago, hablas Español, or what?

we did over 55 shows this year , mostly all high end , high profile stuff . Believe me , this is NO week-end warrior band !!!!
Take it easy, and good luck with the band.
